22. Healthcare-Related Notices, Disclaimers & Compliance

Because MediHope provides services and products related to health, wellness, Traditional Chinese Medicine, herbal products, and other therapeutic modalities, the following additional terms apply:

(a) Medical Advice Disclaimer

  • Information provided on the website, product listings, articles, blogs, consultation descriptions, treatment information, dietary advice, or general health recommendations is for informational purposes only.
  • The Service does not constitute medical, clinical, diagnostic, or professional health advice and must not be relied upon as such.
  • Nothing on this website should replace consultation with a qualified healthcare professional.
  • Always seek advice from your doctor, registered health practitioner, or other licensed medical provider regarding any health concerns, conditions, or treatment decisions.
  • Never delay seeking medical help because of information obtained from this site or from any MediHope communication.

(b) No Guarantee of Therapeutic Outcomes

  • Results from treatments, herbal products, supplements, or wellness services vary from person to person.
  • MediHope makes no guarantee that any product, herbal formula, therapy, or treatment service will be effective for a particular condition, symptom, or medical goal.
  • Statements regarding health-related benefits have not necessarily been evaluated by any regulatory or therapeutic goods authority.
  • Use of any product or service is at your sole discretion and risk.

(c) Australian Health-Regulation Compliance

Where applicable, MediHope complies with relevant Australian laws and professional guidelines, including but not limited to:

  • Australian Health Practitioner Regulation Agency (AHPRA) advertising standards
  • Therapeutic Goods Administration (TGA) guidance for therapeutic claims
  • National Code of Conduct for Health Care Workers
  • Any state or federal health-services legislation overseeing complementary and allied-health practice

All promotional wording, treatment descriptions, testimonials, and references to clinical outcomes are intended to comply with these obligations.
If any claim, term, or description conflicts with applicable laws, it shall be interpreted in the most compliant manner permitted by Australian health regulations.

(d) Consumer Law Obligations

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).
Where products or services are supplied in Australia and ACL applies, consumers may be entitled to guarantees that cannot be excluded.
To the extent permitted by law:

  • our liability is limited to the repair or replacement of goods, or re-supply of services
  • we do not accept responsibility for indirect, consequential, or financial loss arising from the use of our products or services

Where ACL protections apply, they take precedence over any conflicting clause in these Terms.

(e) Collection, Storage & Use of Health Information

Because our services may involve health consultations, treatment booking, intake forms, and clinical record-keeping, we may collect information that is classified as health, medical, or clinical data, which is considered sensitive information under Australian privacy law.

We commit to the following:

  • Personal and health-related information is collected only to provide appropriate services, prescriptions, treatment recommendations, appointments, record-keeping, or customer support.
  • Health information is stored securely and handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
  • We do not disclose identifiable health information to third parties except:
    1. where legally required,
    2. where essential to deliver treatment (e.g., sending prescriptions to a supplier with your consent), or
    3. where reasonably necessary for regulatory compliance.
  • You may request access to your personal health records, subject to identity verification and lawful record-retention obligations.
  • We take reasonable steps to protect health records from misuse, interference, loss, unauthorized access, modification, or disclosure.

For more details, please refer to our Privacy Policy.

(f) Fitness for Use, Allergies & Contraindications

  • Herbal products, supplements, and treatment services may not be suitable for everyone.
  • Always disclose allergies, medication use, medical diagnoses, pregnancy, or any other relevant health information before using our products or booking services.
  • By using our products or services, you acknowledge the need to consult with a qualified practitioner before use.

(g) Emergency Situations

MediHope is not an emergency medical service.
If you are in urgent distress, have acute symptoms, or experience a medical emergency, call 000 or seek immediate hospital or emergency care.
